154 (not currently in proposal) Develop and negotiate water right transaction

Proposed action to achieve the objective(s) Oregon Water Resources Department (OWRD) contacted BPA in regard to water rights at hatchery facilities. In order to finalize water rights at the facilities a Claim of Beneficial Use (COBU) must be submitted to the OWRD. The COBU must be performed by a Certified Water Rights Examiner (CWRE). BPA is requesting funds to contract a CWRE to carry out this task.

Does not implementing this modification jeopardize the ability to achieve existing biological objectives of this project, as well as other projects? Yes

Explain: Not implementing the modification will risk loosing the water right. This will jeopardize the ability of BPA funded hatchery facilities to operate and meet the goals and objectives identified in their Hatchery Master Plans.

Operation of Hatchery Sites By securing water rights to existing hatchery facilities we will be able to maintain operations and production of steelhead and Chinook salmon per their Hatchery Management Plans.
