Operation and maintenance of fish screens

Proposed action to achieve the objective(s) O&M of the screens needs to take place to assure they are meeting NOAA criteria to properly protect steelhead, chinook salmon and all resident fish species.

Does not implementing this modification jeopardize the ability to achieve existing biological objectives of this project, as well as other projects? Yes

Explain: Without adequate operation and maintenance of fish screens and passage facilities, the additional Mid Columbia steelhead and chinook salmon produced by habitat improvements from the project may be diverted to inadequately screened diversions where they would likely perish. NOAA is proposing to eliminate all operation and maintenance funds ($690,000) in 2010. This has been an ongoing project funded by NOAA since 1952 in cooperation with water users (landowners), BPA, NOAA, ODFW, US BOR, CTWSRO, USFWS, GSWCD, OWRD, OWEB, NRCS, and many others. Reductions expected to take place this year, reduce/eliminate O&M personnel in the John Day, Umatilla/Walla Walla Basins. This is expected to take place in the next two months and will happen during critical fall migration/spawning/rearing.

This is a result due to the lack of participation of Mitchell Act funding. Follow-up will need to be done with other federal agencies to understand the Mitchell Act. This is an in-lieu issue for BPA.  This request will be pooled for the 4th Quarterly Review, and a decision in November.

On January 15, 2009 the Council recommended that Bonneville provide the additional expense funds for the screens in Fiscal Year 2009 as requested by ODFW conditioned on Bonneville being able to conclude that the in-lieu prohibition does not apply. In addition, the Council requests a written explanation from Bonneville if it concludes that the in-lieu provision does apply to prohibit Bonneville funding. Second, if Bonneville concludes that the in-lieu provision will not allow additional Bonneville funding, the Council requests that NOAA, Bonneville and ODFW meet and work out another way to ensure the restoration of other funds to the screen o&m as a priority expenditure, and finally, the Council requests that NOAA and Bonneville find a way to fund the screen program in full in Fiscal Year 2010 and beyond, including full restoration of Mitchell Act funding if that is the only legal way to fund these screens.  Under BPA Review
